1 Who we are
Spraggs3D is the trading name of Natalie Spragg, a sole trader, of Midway Place, Gibraltar Lane, Treflach, Oswestry, SY10 9HF. We are not registered for VAT. Email enquiries@spraggs3d.com.
References to “we”, “us” and “Spraggs3D” mean that business. “You” means the person or business ordering parts or using this website.
2 Using this website
You may use this website to read about our services and to send an enquiry. You must not misuse it: no attempts to gain unauthorised access, no automated scraping, no uploading of malicious files.
The content is for general information. Processes, materials, tolerances and lead times shown here are indicative. The binding figures are the ones on your quotation.
3 Your design and your files
You keep all intellectual property rights in the designs, drawings and CAD files you send us. We claim no rights in them.
You confirm that you are entitled to have the parts made: that the design is yours or you have permission to use it, and that making it does not infringe anyone else’s rights. You are responsible for that; we do not check it.
We use your files only to prepare a quotation and to make your parts. We do not share them. Files attached to enquiries that do not proceed to an order are deleted after 90 days. Files for orders that go ahead are kept while you remain a customer and deleted two months after your last order.
4 Confidentiality
We treat your enquiry, your files and the fact that you are a customer as confidential. We will not disclose them to third parties except a service provider acting for us under confidentiality obligations, or where the law requires it.
If you need a signed non-disclosure agreement in place before you send files, tell us and we will arrange one.
5 Quotations
We aim to send a quotation and a timeline within 5 working days of receiving your enquiry. A quotation is valid for 30 days from its date unless it says otherwise. We may withdraw or revise a quotation before you accept it, for example if the file we were sent turns out not to match the brief.
The quotation states the process and material it is priced for, the quantity, the achievable dimensional tolerance, the price, and the expected date. If any of those change, the price may change and we will re-quote before proceeding. Our minimum order value is £75.
6 Orders and payment
A contract is formed when you accept a quotation in writing and we acknowledge the order.
If you are a new customer, you pay 50% of the quoted price when you place the order and the balance on completion. Existing customers pay the full price on completion. Each invoice shows its due date. Where an order includes a prototype and a production run, we may invoice them separately.
We are not registered for VAT, so no VAT is charged. Prices exclude carriage unless the quotation says otherwise.
If an invoice is not paid by its due date we may charge interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998, and may suspend work on any other order for you.
7 Cancellation and changes
If you cancel an order after we have started work, you pay for the work done and materials committed up to the point we receive your cancellation in writing, plus any non-cancellable costs we have incurred. Our refund policy sets out how that is worked out.
Changes to a design after the order is placed are treated as a new quotation for the changed work.
8 Delivery, risk and title
Delivery dates are estimates given in good faith. We are not liable for delay caused by something outside our reasonable control, and time is not of the essence unless we have agreed that in writing.
Risk in the parts passes to you on delivery, or on collection if you collect. Title in the parts stays with us until we have received payment in full for that order.
9 Tolerances and fitness for purpose
3D printed parts are made to the dimensional tolerance stated on the quotation for the chosen process and material. That figure is the standard the parts are made to. Additive processes have inherent variation in surface finish, layer adhesion and dimensional accuracy that differs from machined or moulded parts.
We make the part to your design. We do not assess whether the design is fit for its intended purpose: the material choice, the geometry, the safety factors and the suitability of an additive part for the application are your responsibility. Our materials are not certified for food contact or for medical use, and parts must not be used where that certification is needed.
10 Inspection and acceptance
Check the parts on delivery. Tell us about any shortage, damage or parts that do not meet the stated tolerance or specification within 14 days of delivery, with photographs and measurements.
Where parts do not meet the stated tolerance or specification, we will, at our option, remake or refund them. That is your only remedy for defective parts.
If you do not tell us about a problem within 14 days, the parts are treated as accepted as seen.
11 Liability
Parts are supplied as seen once accepted under clause 10. How you use them, what you fit them to and what you sell them on for is your responsibility, and any liability arising from that use rests with you.
To the fullest extent the law allows, we exclude all liability to you arising out of or in connection with an order, whether in contract, tort (including negligence) or otherwise, other than our obligation to remake or refund under clause 10. In particular, we are not liable for loss of profit, loss of production, loss of contracts, wasted expenditure, or any indirect or consequential loss.
If, despite this, we are found liable to you, our total liability for an order is limited to the price you paid for that order.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.
12 Records
We keep invoices for as long as HMRC requires. Other customer and job records are kept while you remain a customer, and your account is closed and those records deleted two months after your last order. Our privacy notice has the detail.
13 If you buy as a consumer
We mainly sell to businesses. If we agree to make parts for you as a private individual, your rights under the Consumer Rights Act 2015 still apply and nothing in these terms takes them away; clause 11 does not apply to you except for its final paragraph. Because the parts are made to your own specification, the 14-day right to cancel a distance purchase does not apply once we have started making them.
14 General
These terms are the whole agreement between us for the supply of parts, and replace anything said or written before. No one other than you and us has any right to enforce them. They are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that a consumer living in Scotland or Northern Ireland may bring proceedings in their local courts.
We may update these terms. The version in force when you accept a quotation is the one that applies to that order.
